Welcome to Almorio. These Terms of Service ("Terms") govern your access to and use of the Almorio website, online store, and all related content, features, products, and services (collectively, the "Services"). The Services are provided by Almorio ("Almorio," "we," "us," or "our") and are hosted on Shopify, which provides our underlying e-commerce infrastructure.
Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitation of liability, and the governing law for any dispute.
By visiting, browsing, or using the Services, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
These Terms do not affect any of your statutory rights as a consumer under UK law, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where any provision of these Terms conflicts with your statutory rights, your statutory rights prevail.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your country of residence, to use the Services or place an order. By using the Services, you confirm that you meet this requirement and that any information you provide is accurate, current, and complete.
You may be asked to create an account to access certain features. You are responsible for keeping your account credentials confidential and for all activity that takes place under your account. Please contact us at info@almorio.com if you suspect unauthorised use of your account. You may not transfer, sell, or assign your account to anyone else.
2. Our products
We sell beauty tools and related accessories. We make every effort to display accurate product descriptions, images, and prices on the Services, but please note:
- Product colours and finishes may vary slightly from how they appear on your screen, due to differences in device displays and lighting.
- Product descriptions, specifications, and availability may change at any time without notice.
- We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion, including orders that appear to be for resale.
Our products are intended for personal cosmetic and beauty-care use only and are not medical devices. Please follow the instructions provided with each product. If you have a skin condition, are pregnant, or have any concerns about whether a product is appropriate for you, consult a qualified healthcare professional before use.
3. Orders and order acceptance
When you place an order through the Services, you are making an offer to purchase. A binding contract is formed only when we send you an order confirmation email indicating that your order has been accepted and is being processed. We reserve the right to refuse or cancel any order at our discretion - including after an order confirmation has been sent - for reasons including suspected fraud, errors in pricing or product information, inventory limitations, or breach of these Terms.
If we cancel an order after payment has been processed, we will refund you to your original payment method without undue delay.
You confirm that purchases are for your personal, non-commercial use and not for resale or redistribution. Please review your order carefully before submitting it; we may be unable to modify or cancel orders once they have entered fulfilment.
4. Pricing, payment, and taxes
All prices are listed in pounds sterling (GBP) and include VAT where applicable. Delivery charges, where applicable, are shown separately at checkout.
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is accepted, as shown in your order-confirmation email. Promotions may be governed by separate terms; in case of conflict, the promotion terms control for that promotion.
You confirm that (i) the payment information you provide is true, correct, and complete; (ii) you are authorised to use the payment method; and (iii) the charges incurred will be honoured by your card issuer or payment provider. Payment is processed by Shopify Payments and other PCI-compliant payment processors.
If a product is listed at an incorrect price or with incorrect information due to a typographical or system error, we reserve the right to refuse or cancel orders for that product, whether or not the order has been confirmed and your payment has been processed. If we cancel for this reason, we will refund the amount paid in full.
5. Delivery
We currently deliver to addresses within the United Kingdom only. Delivery options, costs, and estimated times are shown at checkout and described in our Shipping Policy.
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by couriers, weather, peak periods, or events outside our reasonable control. Risk in the products passes to you when they are delivered to the address you have provided. Title in the products passes to you when we have received payment in full.
6. Returns, refunds, and your right to cancel
Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. Please read it before purchasing.
In addition to your contractual rights under our Refund Policy, you have a statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, allowing you to cancel your order within 14 days of delivery for any reason. Full details are in our Refund Policy.
Faulty or misdescribed goods are covered by your rights under the Consumer Rights Act 2015, including the short-term right to reject within 30 days, the right to repair or replacement, and the right to a price reduction or final right to reject in certain circumstances. Nothing in these Terms limits these statutory rights.
7. Intellectual property
The Services and all content on them - including the Almorio name and logo, product names, text, graphics, photos, videos, illustrations, designs, the look and feel of the Services, and the selection and arrangement of all of the foregoing - are owned by Almorio or our licensors and are protected by UK and international copyright, trademark, and other intellectual-property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes only. You may not, without our prior written permission: copy, reproduce, distribute, publicly display, publish, modify, create derivative works of, sell, license, or otherwise exploit any part of the Services or its content; use any data-mining, scraping, or similar tools; remove copyright, trademark, or proprietary notices; or use our trademarks or branding in a way that suggests sponsorship or endorsement we have not granted.
All rights not expressly granted to you are reserved by Almorio and its licensors.
8. User submissions, reviews, and feedback
You may have the opportunity to submit reviews, photos, comments, suggestions, or other content to the Services ("User Content"). You retain ownership of your User Content, but by submitting it you grant Almorio a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in any media, including for advertising and marketing.
You confirm that: (i) you own or have all rights necessary to submit your User Content and grant the licence above; (ii) your User Content is accurate and not misleading; (iii) you have disclosed any material connection with Almorio (such as receiving free products or compensation) where required by Advertising Standards Authority (ASA) and Competition and Markets Authority (CMA) guidelines; (iv) your User Content does not infringe any third party's rights; and (v) your User Content does not contain anything unlawful, defamatory, harassing, obscene, threatening, or otherwise objectionable.
We have no obligation to monitor, edit, or remove User Content, but we reserve the right to do so at any time, in our sole discretion.
9. Prohibited uses
You agree not to use the Services:
- For any unlawful purpose, or in violation of any applicable UK or international law or regulation;
- To infringe or violate the intellectual-property, privacy, or other rights of Almorio or any third party;
- To harass, abuse, threaten, or harm any person;
- To submit false, misleading, or fraudulent information, including in connection with any order, return, or chargeback;
- To distribute viruses, malware, or other harmful code, or to disrupt or interfere with the Services or any related systems;
- To use any robot, spider, scraper, data-mining tool, AI agent, or other automated means to access the Services, except as expressly permitted by us or for legitimate public-search-engine indexing;
- To bypass, disable, or interfere with security or access-control measures;
- To collect personal information about other users; or
- To send unsolicited promotional communications.
We may suspend or terminate your access to the Services at any time, without notice, if we believe you have breached these Terms or pose a risk to Almorio, our customers, or the Services.
10. Third-party links and services
The Services may contain links to third-party websites, products, or services. We are not responsible for the content, policies, or practices of any third party. If you choose to access a third-party site, you do so at your own risk, and we encourage you to review their terms and privacy policy.
11. Relationship with Shopify
The Services are hosted by Shopify Inc. Any sale or transaction conducted through the Services is between you and Almorio; Shopify is not a party to that transaction. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Almorio, including any damage or loss arising from any product or service. You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Almorio.
12. Privacy
Our collection and use of personal information in connection with the Services is described in our Privacy Policy. By using the Services, you confirm that you have read and understood our Privacy Policy.
13. Disclaimer of warranties
Except as expressly required by applicable law (including the Consumer Rights Act 2015), the Services and all content on them are provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Nothing in these Terms excludes or limits any rights you have as a consumer under UK law, including under the Consumer Rights Act 2015. If you are a consumer, the products you buy from us must be of satisfactory quality, fit for purpose, and as described, and these statutory rights cannot be excluded.
14. Limitation of liability
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of the terms implied by sections 9 to 11 of the Consumer Rights Act 2015 (title, satisfactory quality, fitness for purpose, description); or (d) any other liability that cannot be excluded or limited under UK law.
Subject to the above, to the fullest extent permitted by law:
- We will not be liable for any loss or damage that was not reasonably foreseeable to both you and us when these Terms were formed.
- We will not be liable for any loss arising from your failure to comply with these Terms.
- We are not liable for business losses. Our products are supplied for domestic and private use; if you use them for any commercial, business, or resale purpose, we will have no liability for any loss of profit, loss of business, business interruption, or loss of business opportunity.
15. Indemnity
You agree to indemnify and hold Almorio and its affiliates, officers, directors, employees, agents, and licensors harmless from any losses, damages, liabilities, and reasonable legal costs arising out of or related to: (i) your misuse of the Services or any product; (ii) your breach of these Terms; (iii) your breach of any applicable law or third-party rights; or (iv) your User Content. This clause does not apply to consumers acting outside of any trade, business, craft, or profession.
16. Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without notice, where we reasonably believe you have breached these Terms. Upon termination, the following sections will survive: Intellectual Property, User Submissions, Disclaimer of Warranties, Limitation of Liability, Indemnity, Governing Law, and any other provisions that by their nature should survive.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Where required by law, we will provide additional notice. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you do not accept the changes, you should stop using the Services.
18. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales.
If you are a consumer:
- You will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
- Any dispute may be brought in the courts of England and Wales, or in the courts of the part of the United Kingdom in which you live.
19. Alternative dispute resolution
If you have a complaint that we have been unable to resolve, you may have the option to refer the dispute to an alternative dispute resolution (ADR) provider. We are not currently signed up to a specific ADR scheme, but if you would like to explore ADR options, please contact us at info@almorio.com and we will provide further information.
20. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on the Services, constitute the entire agreement between you and Almorio.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms at any time without notice, provided this does not adversely affect your rights.
No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Almorio.
Third-party rights. A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
